                            Historical      Slaps  

 
                     We go  back to Mahabharat  times, when, Draupadi  wife of his younger brother Yudhishtheer  was dragged   ignominiously into  the darbar of Duryodhan, she was humiliated , disgraced and an obscene gesture was made by Duryodhan   to her to sit on his lap.  , she was about to be undressed in the full view of the courtesans and Bhisma his grand father was present in the darbar, but he did not do any thing  to save the grace of his daughter-in-law, he simply went on seeing the tragedy  like a coward. It was Sri Krishna who saved the grace of Draupadi , and that is why  Krishna  is known as grace-saver.

      Ultimately  war  took place, Bhisma was badly injured and was  put on a pyre of nails and was awaiting call of the death.

      Bhisma delivered some lessons on morality,dharma, justice. These lessons are famous as “  Shanti Parva “ in Mahabharat. After listening to such a discourse , Draupadi lapsed in to the events when she was humiliated in the darbar of Duryodhan in the presence of the ailing strong man ,saw to Bhasma and some satirical expressions rushed  on her face and  she laughed with contempt .Bhisma saw this,  and asked her the reason for laughing and acting with ridicule before the elders.

     Draupadi replied, “  I can not disobey your orders to show cause , more over if I do not state the  true reasons for  this conduct, I will be accused of  discourtesy . To-day you are teaching us  dharma, justice and  morality, but when I was humiliated in the darbar of Duryodhan  and Dushasan was undressing me in full view of yours , where all this knowledge  on dharma, morality and culture had gone ? I feel you might have acquired this knowledge after that incident , alas, it was this thought which has prompted me to laugh “

      This was such a historical slap on the face of Bhisma, that even after lapse of thousands of  years, the markings of the slap are still visible on the face of Bhisma  whenever  one reads that chapter of Mahabharat.

     History some times gives one and many some opportunity to act  like brave and reserve a place of dignity and honour, but if one misses that opportunity and fails to call up enough courage , repents for the life time his failure to grab the opportunity. What Bhisma should have done ? He was after all grand-father of Duryodhan and were some options before him  1. He could have  rushed  to Draupadi and  escorted  her to safety,  2. He could have  raised his voice against the inhuman and unjust behavior of Duryodhan drawn him into arguments and could have  persuaded him not to call Draupadi in the darbar,3. He could have thrashed Dushasan who started undressing Draupadi  4. He could have straight gone to Duryodhan and could have slapped him in full view of the courtesans. 5.He did not even boycott the darbar  in protest against the wrong treatment to Draupadi. Bhisma did not chose any such options but remained seated in his chair and went on seeing the  unseeable,  This would have been a sign of cowardice again but a slight action  would have earned  him some relief in the eyes of  the world.  

         When events occur, man should try to mould those events in accordance with  his personality, culture and image. He should never remain a silent spectator to any tragic event occurring before his eyes or at a distant place. Those who are leaders should take stand on the issues whenever they crop up. That is the test  of sound and honest leadership.

        Slap on the face of President of United States of America    

      This is truly a historical  incident.

 USA’s President Mr.  Grant was a very religious man and attended the Church every Sunday. Once he went to the church along with his family and the Ministers.The one year old son of the President  was playing  with some one during the speech of the priest and the priest was disturbed. This caused annoyance to the President  and he slapped his son angrily for this . As a result  the child started weeping loudly.

      The aged mother of the President was sitting next to the President , got up from her seat and slapped the President in full view of all the present in the church.

    President Grant simply remained seated and could not do any thing  !

      When the prayer was over , some Ministers  told the mother, “ Madam , you did not do a correct thing in slapping the President in our presence. “

     She replied,  “ He slapped his  so little son on a superfluous fault in the presence of God,  and it was a big crime committed in the church in the presence of God. So , why should not slap my son for such a big crime  ?”

            The mother of President Grant deserves a position much more higher than Bhisma who  remained seated with folded hands when Draupadi ( his daughter-in-law ) was disgraced in open darbar.

They were Directors of Music   !

                        The film  industry is known for its cut throat competition. But yet there were some  who created men out of clay  , they encouraged their second-in-command to rise  and be equal to them  !

                        This is the story of Hindi musician Ravi , who was assistant to famous film musician Hemant Kumar. He was drawing monthly salary and was happy to  serve his master. In fact Ravi became famous as permanent Assistant to Hemant  Kumar.

                       Once Hemant Kumar  told him in a friendly spirit, “ yar,  tum achchhe sangitkar to ho hi,  lekin svatantra hokar apni imej banao.Mere sath hi rahoge, to sari jhindagi assistantke assistant hi rah jaoge.ab merese alag hokar tum svatantra sangitkarki hesiyatse kaam karma shuru karo. (   dost, you are truly a good musician, but you should create your image independenly of me.If you will continue with me, you will  remain my assistant for ever .Now you get separate from me and be a Music Director own your own. “  

        Ravi was shocked on hearing this , as his house-hold was running on the monthly salary received from Hemant   Kumar , and now he was asking him to be separate from him , that meant stoppage of the salary, how the house hold expenses could be met ?

        Hemant Kumar added, “ I am going to Kashmir for three months, so there would not be any musical activity for three months . You go to Shri Nadiyadvala and meet him “

       Ravi went to  producer Nadiyadavala and told him ,” Sir, I am working as assistant to Hemant Kumar, but now give me some independent job “ 

      Producer Nadiyadvala called his  Accountant and said, “   Get signatures of Ravi on contracts of three films, and pay him some advance money “

     That was done, it was Hemant Kumar who had arranged  the things with Nadiyadvala
and India got a first rate Music Director thereafter  ! And we got musical hits likeYeh Raste hai Pyarke, Do Badan, AAnkhe, Gumarah, and Aaj aur Kal  films

                   Develop Independent Image   -  K.L.Saigal

                The famous Hindi singer Mukesh had memorized number of songs of Saigal and  was imitating  him. Once he went to Saigal and started singing Saigal’s songs , Saigal was very much pleased   on hearing the voice of Mukesh, but he advised him,
                
                 “ When you can sing so nicely, why are you imitating Saigal ?You should develop your caliber in your own way  and create an image of a singer  independently . If you will create an independent identity of a singer , then only you  will accomplish some thing in life “

                 Mukesh took this advice by heart and charted  an independent course, he contacted poets, musicians, directors .He met his equals in Raj Kapur, Shakar   Jaikishan and the trio made history on Hindi Screen !  Some of his very famous songs are 1. Aansu bhari hai ye jeevanki rahe ( Parvarish ) 2.kahee door jab din dhal jaaye ( Aanand ) 3. Chalari sajani ab kyaa soche ( Bambaika Baabu ) 4. Tumhe jeendageeke ujaale mubaarak ,  andhere hame aaj raas aagaye hai (  Purnimaa )  5. Jinhe ham bhulana chahe, vo aksar yad aatehay(  Abaru )  6. Bhuli hui yado hame itna na satao (  Sanyog )  7. Muze tumse kuchhabhi na chaahiye ( Kanhaiya ) 8. Vakta karata jo vafa , aap hamare hote (  Dilne Pukara ) 9. Suhani Chandni rate hame sone nahi deti ( Mukti ) . 


       “ Ek Bangla Bane Nyara “ -  Kundanlal Saigal

       The great Indian singer Saigal  ( 11.4.1904- 18.1.1947 )   had sung 110 Hindi songs and had acted in 28 films. His favourite rag was Bhairavi. He believed that once a person mastered this rag , the rest of rags will be  easy to master.. Among his famous songs are 1. Ek Bangla Bane Nyara 2. Babul  Mora naihar chhuto jay  3.   Jab Dil Hi  Tut Gaya

        But even at the age of 42 he was  a man of humility and introspective. If some one praised him to much he would  promptly say, “You see I have sung only songs., and have not killed any tiger or lion .  These songs were written by some poets and I sang them only “

        While giving tribute to Saigal , the famous musician Naushad had to  say ‘

       “   Saigal ko faramosh koi kar nahee shakta,
           Vo aisa amar hai ki, kabhi mar nahee shakta “
          

                             ( faramosh means   to beat  )
              Chappals made of tyres  :  

         This incident happened when the  Vietnamese Revolutionary and the President of Vietnam   Ho Chi Minh   visited India.  Though he was President of a country, he used chappals made from used tyres of vehicles  and his cap was made of straw.   He was involved in a violent revolution and yet he  had a strong  belief in the Non-Violence of Gandhi and in a way he took pride in calling himself a disciple of Gandhi.

        In a function held in his honour, one speaker compared him with Gandhi, Ho Chi Minh did not like this comparison. And his face exhibited his displeasure on hearing this simily..

        While replying to the reception, he said, “ Some speakers have compared me to Gandhi, but I do not like this comparison. Gandhi  had a grand personality, I am a pygmy  before him. I am certainly a revolutionary  but I can never be compared to Gandhi at all.”

                  I am a poet only   _ Surdas

          Once Mogal Emperor Akbar called Surdas in his darbar and asked,

             “    Whoes poems are superior , yours , or those of Tulsidas ?  “
              “ Mine, of course ! “  replied Surdas.
        Akbar  dragged him in further discussion, “ Then  what about the quality of  the poems of Tulsidas ? “
                       Surdas replied with all humility, “ I have written poems only, and so I am a poet. But Tulsidas  is a saint and more he is a visionary , which I am not “

      Akbar was taken aback and his power melted before the humility of Surdas.

                “ I will do it again “ – K.M.Munshi

 The Chief Justice Beaumont was a severe critic of the Govt and  whenever he could find an opportunity  he would  readily lambaste the Govt. His armoury of  strictures , criticism and taunts was ever ready  for this pious task  !  

         Communal riots in Bombay  took place  in 1938  .. K.M.Munshi was   Home Minister of Bombay State then. Certain news papers were publishing the names of the killed persons , exposing the identity of their community , soon reading the names both the communities   got agitated  and were boiling with a sense of revenge. This added fuel to the fire and riots once started did not abate.The Govt was very much embarrassed and wanted to put an end to the riots  at the earliest.
          
         Govt. warned some  news papers, some followed the hint and stopped publishing the names of the killed persons, but some were adamant and  did not fall in line. As a result , the Govt asked the Dist. Magistrate to promulgate imposition of censorship on all papers, under Section 144 of the Criminal Procedure Code , this was done, censorship was imposed and the censorship had a  salutary effect, the communal riots stopped within 3 days. As the riots had stopped, there was no necessity for its continuance and so the censorship was withdrawn.

        In spite of this, one news paper challenged the order of censorship in the Bombay High Court . In course of hearing , the CJ criticized the Govt in undue harsh words  in the judgement and declared it illegal.

          The CJ and Munshi met during a social engagement   , when the Chief Justice    told Munshi in a posture of a victor that “ Munshi , I declared your order under sec 144 illegal  “ . 

           Munshi was not perturbed  and  told  Chief justice, “ If the riots will  commence again , I will not hesitate to declare censorship again and again.  My duty is to maintain law and order. Your duty starts when law and order is restored.  You , the judiciary , will work only if  the law and order is maintained.   “

 Mohammed Ali Jinna was an eminent  lawyer in Bombay High Court  during  1914-15.
       He had robust  legal practice and was also Member of the Bombay  Legislative Assembly.
        It so happened that one wealthy plaintiff sent his case to Mr. Jinna  and showed readiness to pay a fee of Rs. 10,000 ( Ten thousand ) . Rs 10,000 was a big amount a hundred years ago. There was also a rider with the file requesting Mr. Jinna  to ask some  questions  ( Legislative Assembly Questions ) to the Government. Jinnah saw through the game of the industrialist that  he was trying to buy him in the form of giving him this case and that  the fee of Rs. 10,000 ( Ten thousand ) was actually  meant not  as a remuneration but as a reward for doing this illegal act.
       Mr. Jinnah  took great offence to the gesture of the  industrialist, took  the file of the brief in his hand, got up from his chair  went to the window overlooking the sea  ( his office was located on  Marine Lines, Bombay, and straightway  threw the file down below, saying “ If your client thinks that I can be bribed  to ask these Questions in the Assembly, he is greatly mistaken, go to hell “
        
  This incident took place in 1914.

   But India was to see a reversal of the incident after 91 years in New Delhi., in 2006.

.        Now see the travesty of fate.

         Some members of India’s  Parliament had taken money to ask some  Questions to the Government , the charges were proved and they were disqualified from the membership of the Parliament  

       The acceptors of money for asking Questions in the Parliament lost their membership of the Parliament and the one who  threw the file into the  air ,  was destined to become first Governor General  of Pakistan and later the first President of the  breakaway   country  Pakistan .

/         Difference between judicial mind and judicious mind

            Have you ever seen the difference between the two ? Have you seen how a blurred line divides the two ?                                                                                                                        .            Then this is the judicial history.

              Former  Central Minister  Kanaiyalal   Munshi has described this incident in his book   “   50 Years  of Bombay High Court   “

              A Hindu woman Bai Gulab was married to one Jivan Lal under Anuloma system of Hindu Law  but she did not want to go and live with Jivan Lal , so she engaged Munshi as her lawyer  and  had challenged this system of Anuloma .Munshi took a stand in the court of Justice  Kajiji  stating that such marriages are unlawful under the Hindu law.                 
                The arguments for the applicant and the respondent were heard                                                                     

                 Munshi observed the manner of hearing by the justice and got an inkling that the Justice would deliver judgement in favour of  Jivan Lal. 
    
                 The Justice started to dictate his judgement in the open court , and Munshi started to write down salient  points of the verbal judgement  on a loose sheet of paper . In the last, the Justice  delivered  judgement   against the client of Munshi and instructed him  to produce Bai Gulab before him in the court as he wanted to hand over custody of hers to Jivan Lal at 3 o’clock in the afternoon.. Munshi  requested Justice to postpone this provision of handing over   Bai Gulab to Jivan Lal  upto the time of completition of the appeal period , but Kajiji was adamant  and did not oblige Munshi. After stating this Justice Kajiji retired into his chamber for recess.

                  Now the recess time had already started , copy of the judgement was not given as it was yet to be typed out and there was no time for filing an appeal against the judgement  as the Justice wanted to hand over Bai Gulab to Jivan Lal immediately.

                   What to do now ?

                    Munshi went into the chamber of Chief Justice Macleod  and explained facts of the case and represented that though he had requested to defer the matter of custody up to the disposal of  appeal , the Justice was not listening anything and is all bent upon  handing over custody of Bai Gulab to Jivan Lal. If the judgement of Kajiji was to be respected, the  woman  would become pregnant by the legal process  was over and  that the complaining party was  representing  from the very beginning that this marriage was not legal .

        Now Chief Justice took the paper tendered by Munshi in his possession  called the clerk and asked him to admit this paper as appeal, give it Number and post the matter for urgent hearing at 0330  PM same day ! Then the Chief Justice  instructed  Munshi  to convey his order to the lawyer of Jivan Lal to remain present in his  Court at 03:30   PM the same day..

      The  scene was  now shifted  in the court of the Chief Justice at 0330 afternoon .

      The defence lawyer fulminated with his angry outbursts against this extra-legal procedure adopted by the Chief Justice, in absence of an appeal, then the Chief Justice showed him the  appeal-document and said he had admitted this as an appeal  , and the hearing of the appeal went on.

      This was application of judicious mind

       It is another matter the Chief Justice delivered a judgement  confirming the order of Justice Kajiji later on, on  13th Oct 1921 after making a deep study of the writings of Yagnavalkya Rishi , Manu Smruti, commentaries of Vijaneshvar  and Caste System of India.. The judgement of the Chief Justice   Macleod is itself  full of learning  on Hindu marriages  when the males and females belong to different castes .
